SECTION 2.80. - RIGHT TO ADMINISTRATIVE APPEAL.

If any person shall be aggrieved by any administrative decision of the City Manager or any other City official, or any Board or Commission not having within its structure an appellate procedure, such aggrieved person is entitled to a full hearing before the Council upon serving a written request therefor upon the Mayor and City Manager at least five (5) days prior to any regular Council meeting. Such request shall contain a general statement setting forth the administrative decision to be challenged by the appellant. At such hearing the appellant may present any evidence he deems pertinent to the appeal, but the City shall not be required to keep a verbatim record of the proceedings. The Mayor, or other officer presiding at the hearing, may, in the interest of justice or to comply with time requirements and on his own motion or the motion of the appellant, the City Manager, or a member of the Council, adjourn the hearing to a more convenient time or place; but such time or place shall be fixed and determined before adjournment so as to avoid the necessity for formal notice of reconvening. No appeal is allowed to the City Council from any personnel decision.

SECTION 2.073. - FAILURE TO COMPLY.

Failure to comply with any provision of Sections 2.07, 2.071, and 2.072 shall not constitute a violation subjecting the person who fails to comply to a fine or penalty, unless the failure to comply is willful and deliberate.

You do not have to comply to unlawful orders. Governor mandates are just that. A governor has no authority to make laws or mandate anything without legislative approval. And that approval has to go through a very specific process (here in Minnesota anyway). If your governor doesn’t go through that process, it’s moot. Here’s what the Black’s Law Dictionary (the bible of law) says a mandate is:

A mandate has to be done by a court or is a CONTRACT. What is a contract?

Did I agree to the contract the Governor of Minnesota mandated in 2020? No, I did not. Therefore, that mandate means nothing. Yet, our courts and law enforcement held up that mandate as law. People went to jail because they kept their businesses open during the mandated lockdown. The unlawful lockdown. That tells me our courts and law enforcement are also corrupt. This is tyranny.

What will YOU do about it? Will you speak out or are you too afraid? Do you care that [s]elected officials are making all sorts of decisions for us without our consent?

Did your elected officials take an oath? Is it on file and available for all the public to see? By law, this should be the case. If it’s not, then are they lawfully in office? The oath is what binds your government to do the right thing by the people. So, by what authority do they hold that office if their oath is not in tact?

One thing to remember is that Man was created by God, and Government was created by Man. Government and all it’s employees (elected and selected officials) submit to the People’s authority which is bound by our Constitution.

We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.

In every state’s Constitution there is a statement like the one above - the object of government is for the security and benefit of the people IN WHOM all political power in inherent (in·her·ent adjective - existing in something as a permanent, essential, or characteristic attribute.) Meaning the political power of the people has been there from the beginning. We have lost this power because we’ve been busy. Busy working, getting our kids to school, and picking out backsplash. We’ve been on mental vacation for decades. It’s now time, as a society, to wake up from the day dream and get back to reality or we will lose it for good. It’s time to stretch our politcal power and hold our [s]elected officials accountable.

This is a template I’ve used (with some notes for you). This is particular to my state of Minnesota. Make sure you look up your city and state codes when referencing them.

Another thing to think about is this - do your [s]elected officials have an oath of office on file? Did they take an oath publicly? Are they insured and bonded? These are all things that are important to know, because if they break their oath they are then liable to having their bonding stripped away. I don’t know many cases where this has happened, but I do know that the threat of it is sometimes enough to get them to listen.

I’ve been on this road and researching for three years now. It will take some time and effort, but I believe it can be done - for any elected official that has overstepped their authority: Mayor, city council, county commission, governor, senator, etc. Malfeasance. Maladministration. Or just plain usurping a position. Did they take an official oath?
